2. Information that we collect from you as a Donor to a Charity on this Website

   If you register on this Website, we will collect your name, title, e-mail address, mobile telephone number and your password. By registering as a Donor on this Website, you will be consenting to us processing your personal information for the purpose of donating funds to the Charity you have chosen to benefit from the donations which you are making. We will use and process your personal data to enable the Charity to receive information about you. Charities to which you have donated may from time to time send us updates on the work projects which they are carrying out. We may send these updates to you by email for your information, provided you have not opted out of receiving them. We will not pass on any personal data to any Charity or other third party. You confirm that the information given is personal to you and you will not give us information on behalf of someone else. By registering on this Website you consent to the transfer by My Good Points of your personal data to areas outside of the European Economic Area from time to time, subject to the condition that such data transfer is in full compliance with Data Protection Legislation. “Data Protection Legislation” means the Data Protection Acts 1988 and 2003 and the EU Data Protection Directive 95/46/EC as such legislation may be amended, extended applied or re-enacted from time to time and includes references to any subordinated legislation made under that legislation.

3. Information we collect from you when you make a donation using this Website.

   If you make a donation using this Website, we collect your full name, your credit or debit card details (including card information) and your billing address. We will only use your card details for processing your donation via our payment partner. We will not pass on your name or address to any Charity. On making a donation using this Website you are giving us your consent to collect and process your personal data for the purpose of processing your donation.

4. Keeping you data Secure

   We employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period as long as the law requires. It is your responsibility to keep your password secure at all times to avoid unauthorized use of your account.

   The personal data provided is stored on our secure computerised database to enable us to respond to your requests, keep you updated and informed about our work and how your donation(s) is being used. We may communicate with you in the future by mail, email and telephone. 6. Accessing and Updating

   You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. We will accede to any such valid requests within 40 calendar days of the receipt of a valid request in writing. We reserve the right to request you to provide additional information in order to enable us to identify your personal data and/or to verify your identity. Please see the relevant section of the Website for eligibility criteria for registration as a Charity. These terms and conditions apply to all users of the Website, irrespective of whether you are a Donor, a Charity or if you are only browsing the Website.
   • We may revise these terms and conditions at any time by updating this posting. It is your responsibility to check this Website from time to time to review the latest version of our terms and conditions. The version of the terms and conditions which are applicable to you from time to time are those set out here. Every time that you use the Website, you are deemed to have understood and accepted the latest terms and conditions as published at that time.    • ANY DONATION YOU MAKE VIA THE WEBSITE WILL BE PROCESSED IMMEDIATELY BY US AND THE PROCESSING BANK OR CREDIT CARD COMPANY. YOU ACKNOWLEDGE THAT IN THE ABSENCE OF FRAUD, YOU SHALL NOT HAVE ANY RIGHT OF CANCELLATION OF YOUR DONATION AND IN PLACING A DONATION, YOU WAIVE ANY STATUTORY RIGHTS YOU MAY HAVE TO CANCELLATION OF THE PROCESSING OF YOUR DONATION BY US.
2. REGISTRATION AS A DONOR
   • You warrant, undertake and agree that:
     • You are free to register as a Donor and to create your own account.
     • The information that is registered by you is true, accurate, current and complete and you undertake to maintain and promptly update the information to keep it true, accurate and complete.
     • You are authorised and/or have the capacity to enter into this binding contract with us.
   • Each account registration is for a single user only. We advise that you do not share your user name or password with any other person/user.
   • Responsibility for the security of any passwords issued rests with you as does responsibility for all activities that occur under that password. If you know or suspect that someone else knows your password, you should contact us immediately. We do not accept any responsibility for fraudulent use of any account whereby the username and password has been used to access the account.
   • We reserve in our absolute discretion the right to refuse and/or cancel your registration and/or to prevent donations from being made via the Website or to withdraw the donation service generally.
   • We do not accept any responsibility for or endorse any of the activities of Charities registered with this Website.
   • We have no control over whether Charities and third parties will accept any proposed donations via the Website.
   • We keep a record of each Donor’s registration details and details of any donations made by you for a period ending six years after the termination of the Donor’s registration. See our Privacy Policy for more details.
3. DONATIONS
   • We accept no responsibility for any use or purpose which your nominated Charity may make in respect of any donation made through this Website. We take no responsibility for your dissatisfaction with the use of your donation to any Charity. If you have cause for dissatisfaction with the use of your donation, you should contact the Charity directly. Without limitation to the above or any other provision of these terms and conditions, we shall have no liability of any kind in circumstances where the Charity ceases to exist, becomes insolvent, stops carrying on operations for any reason, fails to apply any donation in connection with a particular project (or at all) or otherwise misuses any donation from you.
   • There shall be no refund in respect of any donation made through the Website, unless we are satisfied that your credit card has been used without your authorisation. If you become aware of the unauthorised use of your card then you must contact your card issuer in accordance with your arrangement with them.
   • In the event that you fail to access your account at any time for a period of 180 days or more, we shall have the right at our sole discretion to allocate and donate any balance on your account at that time to any Charity on the Website.
   • We do not accept any liability for donations made to organisations which have ceased to have official charitable status as decreed by the Revenue Commissioners, the Commissioners for Charitable Bequest in Ireland and/or Charities Regulatory Authority or any other competent body or authority.
   • We apply an administrative charge to all donations which are received from you through the Website. This charge is currently set at 3% of the donation amount, which charge will be deducted from your donation at the point of transfer to your account.
   • To make payment instructions you must follow the procedures set out on the Website. On receipt of a valid payment instruction from you we will request your credit card company to pay us the amount of the payment instruction (withdrawal). You must ensure that you have sufficient funds available for the payment instruction. We will pay the amount of the withdrawal (less charges) to your specific Website account. You may then use funds available in your Website account to donate to Charities on the Website.
   • If your credit card company does not provide us with the amount of the payment instruction we reserve the right to reverse any related payment made to a Charity or otherwise, and charge you for such a reverse. We reserve the right to limit the number of credit cards registered to your Website account.
   • Payment instruction can be made with a credit card by registering the details of your credit card on your Website account and making a payment instruction in accordance with instructions on the Website. If the credit card has expired you will not be permitted to make a payment instruction using this credit card. If you are making donations by credit card you hereby agree and assure us that (i) all credit card information supplied is true, correct and complete, (ii) the person making the donation is duly authorised to use the credit card for that purpose; and (iii) the donation and charges will be honoured by your credit card company. If you discover that a donation to your Website account has been made on this Website using your credit card details in circumstances where you had not authorised this, then (provided you have not, through failure to take reasonable care, allowed an unauthorised person to gain access to your credit card, its details or password) we may refund to you the donation to your Website account (less an administration charge) received provided that: (a) you inform us and your credit card company of the unauthorised payment as soon as you discover it; and (b) you co-operate with us and your credit card company and, if necessary, the gardai in relation to the unauthorised use. All donations made via the Website are final unless fraudulent use of the card is proven in accordance with this section. For the avoidance of doubt the provisions regarding refund shall not apply in circumstances where instructions have been received by us to make a donation to a Charity from your Website account, as we have no ability to request the Charity to refund the amount to your Website account in such circumstances.
   • We may from time to time enter into arrangements with third parties who wish to put a payroll giving service in place in respect of their personnel. Any person who participates in such a scheme with their employer/place of work will be deemed to be a Donor as set out in these terms and conditions. The process whereby monies are deducted from relevant salaries and transferred to us will be detailed and agreed between the personnel and their employers/places of work at the time that such persons agree to participate in the payroll giving service.
4. SERVICE ACCESS
   • While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
   • Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
   • We reserve the right to suspend or withdraw the facility for making donations via the Website at any time.

   • We retain the rights to the Website IP and reserve all rights in respect of same. We grant no license or property rights to any such Website IP other than as expressly set out in Section 6.
   • We expressly disclaim any implied warranties of merchantability and fitness for a particular purpose, with respect to any Website IP.
   • The trade marks, copyright and any other intellectual property of other users displayed upon the Website, including names and logos of Charities registered with the Website, may not be used or reproduced without the express written permission of their owners.

     • No graphics on this Website are used separately from accompanying text; and

    • Without prejudice to Sections 6, 7, 8 or 10 or any other terms in any other contract between us, we may terminate your registration with the Website or your use of the Website on written notice (which shall include e-mail) if you breach of any of the terms and conditions of this Website and fail to correct such breach within five (5) days following adequate notice (which shall include e-mail) from us specifying the breach or in the case of a breach of Sections 6, 7, 8 or 10, we may terminate forthwith without notice.
    • You may terminate this your registration with the Website upon written notice (which shall include e-mail) if we go into insolvent liquidation, receivership or examinership or we are deemed to be unable to pay your debts as they fall due within the meaning of section 214 of the Companies Act, 1963 (as amended, extended, consolidated, or replaced).     • Termination of these terms and conditions for any reason shall not affect the accrued rights of the parties.
13. GOVERNING LAW AND JURISDICTION
    • These terms and conditions shall be governed by and construed in accordance with Irish law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Irish courts.
